A HISTORY OF UNION FRUSTRATION & PUBLIC CORRUPTION
In 2008 the Oceanside Police and Firefighters and their Public Union’s battlefield for unrestricted access to the citizen’s tax dollars, is the control of elected officials, and their votes. Nowhere is this battle more evident than the city of Oceanside where the public union’s tactics have become very dirty and very criminal, and this battlefield is not a level playing field. The criminal organization money bag is the Oceanside Fire department, and the protection enforcers are the Oceanside Police Police officers, the District Attorney's Office, corrupt council members, and even the Attorney General's Office
The City of Oceanside is one of the few cities in the county, that does not have limits on financial donations to campaigns. This lack of donation limits, gives the collective financial power of the dominant Fire and Police union candidates, a significant advantage over the average citizen in City Council Elections. Even with this financial advantage, the Fire and Police unions have had difficulty maintaining a three vote control of the City Council, which is critical for upcoming union contract negotiations and contract approval. The next Fire & Police contract was scheduled for January of 2010.
In 2004 the Fire & Police unions had purchased only two solid votes in Council Member’s Jim Wood, X-OPD Officer, and Ester Sanchez (Attorney). These two council members have consistently voted to expand union pay and benefits, and are consistently the recipients of substantial campaign financing and protection from the Fire and Police Unions, thru the front and back doors of re-election campaigns. In the 2004 council elections, pro union council member Jim Wood, a retired OPD officer, was elected as Mayor, while other union supported candidates were defeated. Wood's election to Mayor opened a council seat, and left the council with a two vote split, relative to union control of the council.
A three vote majority was required to name a replacement for the open seat, however, when no majority agreement could be reached, a special election was scheduled and held in 2005, in accordance with established laws. The Fire and Police Unions provided substantial campaign financing for pro union candidates Shari Mackin and Charles Lowery. Shari Mackin was elected to fill the remaining term of Wood's vacated council seat. This provided a three vote union majority with Mackin, Sanchez, and Mayor Wood, that were controlled by the police and fire unions financing.
In a later interview, Council Member Kern stated that one of the first things that was done by the new pro union majority, was to pass ordinances that severely limited citizen supported lobbyist involvement in local politics, however, the ordinance exempted the Oceanside police and fire unions. This discrimination would set up an extremely uneven playing field in favor of the police and fire unions, with no limits on campaign contributions, and no real organized opposition. This was the first step by the police and fire unions to set up future manipulation of votes and elections.
In the November 2006 regular council election, the Fire and Police Unions heavily financed the re-election campaign of Shari Mackin, and once again the election campaign of Charles Lowery. Both candidates lost to Jerome Kern, who was not a guaranteed pro union vote. This has since proved to be the case based on his documented voting record. Council member’s Kern, Chavez, and Feller became a voting majority that did not put the Fire & Police Unions financial interest ahead of the citizens. This election removed the pro union majority vote from the city council, and there would not be another election prior to the January 2010 vote on a new union contract.
In 2008, with a large city budget deficit, the new majority voting trio of Council member’s Kern, Chavez, and Feller, opposed the funding of three new firefighter positions. Against heavy Fire & Police union opposition, Council member Kern went on to recommend the privatization of other fire department services, to save tax dollars and reduce the budget deficit. These events were the red flags that set into motion the Firefighters and Police Union conspiracy to illegally manipulate the votes of citizens, remove Council member Kern, and replace him with the sure pro union vote of Charles Lowery, which had to be done before the January 2010 vote on a new union contract.
The council push by Kern, Feller, and Chavez, for spending and personnel cuts in the Police and Fire Unions, and the privatization of some of the police and fire services to same money, sent a shock wave through the police and fire departments, and their unions. There was no apparent legal way to get control over the council vote before January 2010, so they conspired to do it the illegal way.
THE ELECTION CONSPIRACY
Campaign finance records from the city clerk’s office indicate the conspiracy to recall Kern was underway in the latter half of 2008. As of December 2008 the OFA Union had collected $36,081.37 from the Police Officers, and $67,600.00 from the Firefighters for a total of $99,000.00+. The Firefighters Union donated money using both cash and back door non-monetary contribution to support the council election campaigns of Charles Lowery, Rex Martin, Mayor Wood, and Deputy Mayor Sanchez, even though there was no scheduled council elections until November 2010 and 2012, which was after the union contract vote in January 2010. Lowery and Martin, both long term police and fire union supporters, would become the candidates to replace Kern, if the secretly planned recall conspiracy was successful. The timing of the events indicates the plan required taking advantage of weaknesses in the reporting requirement, and reporting time schedule, for state campaign finance reports. It would also require falsification of the records, which are signed under penalty of perjury.
The primary objectives of the Firefighters & Police Union election fraud conspiracy were:
1. To hide the Firefighters and Police Union’s financial control over the recall election process long enough to manipulate citizen votes and get the recall election on the ballot.
2. To minimize the time available for any citizen opposition groups to form, and start any effective opposition to the fraudulent recall signature drive, once the petition drive became public.
3. Covertly select and finance a private company (The La Jolla Group) to execute the signature petition drive as early as possible in January 2009 to take advantage of the 6 month campaign finance reporting cycles to black out public access to union finance information.
4. Secretly and illegally coordinate the money flow from the Police, Firefighters, and other public unions through and around the Kern Recall committee, to start the signature drive, without raising any red flags that would provide a tip off to potential citizen opposition.
5. Set up and coordinate a media blitz of falsified campaign literature to illegally manipulate the votes of Oceanside citizens, and hide the fraud, to get the signature drive completed, and approved by the council for the special election ballot.
OFA Campaign finance records for 2008 and 2009 show that in late 2008 the Firefighters Union set up the First Money Channel, of a three channel illegal money system designed to hide the unions planned manipulation of citizens votes. The OFA CFR's show that "Independent Expenditures", or direct payments exceeding $33,000.00 had been made for North County Times Ads, Mailers, and Signs, for the benefit of three key political action committees. The payments were made on behalf of the election committee for Charles Lowery, and the re-election committees of Mayor Jim Wood, and Deputy Mayor Esther Sanchez, even though neither was running for re-election until 2012. The money was to finance the production and distribution of misleading and fraudulent campaign literature to to manipulate citizen votes in the petition drive, support the election of Lowery to replace Kern in the Recall election, to be filed in January 2009.
FIREFIGHTERS 2008 - 2009 CAMPAIGN FINANCE RECORDS - AN ILLUSTRATED MAP OF FIRST RESPONDER CRIMINAL CONSPIRACY AND PUBLIC CORRUPTION
On January 23, 2009 the Firefighters Union activated the Second Covert Money Channel when they transferred $5,000.00 to the Committee to Protect and Preserve Parks and Beaches. The OFA needed to get enough money to the Kern Recall committee, to set up the contract with the San Diego based La Jolla Group, to activate the commercial signature drive, as soon as possible. The Parks and Beaches committee officers were former council member Shari Mackin, and Christine Gow, two long term supporters of the Firefighters and Police Unions. This committee as a long established committee had a six month campaign finance reporting requirement like the OFA, and the conspiracy required at least six months to manipulate voters, and gather enough signatures to put the recall on the ballot. As the committee only had a little over $500 in their account, the $5000.00 donation immediately exceeded 80% of the finances of the committee. This activated a state law requiring the committee to identify the financial sponsorship of the Firefighters Union in the title of the campaign finance records, and all subsequent associated documents, ads, flyers, etc. This required notification was not done, and subsequent campaign finance reports were falsified by Shari Mackin, and Christine Gow to hide the donation source, being the Firefighters Union. Falsification of Public Records is criminal conduct, signed under penalty of perjury, and even worse when the falsification is done in furtherance of a conspiracy (Penal Code Sec. 182) to tamper with an election and manipulate the votes of citizens.
Three days later on January 26, the “Citizens To Recall Kern For Fair And Balanced Government” filed their documents with the City Clerk. The fire and police unions $5000.00, along with Christine Gow as an officer, was transferred from the Parks and Beaches Committee, to the Kern Recall Committee. The Kern Recall committee as a new PAC was on a 90 day reporting requirement which is why the money was illegally channeled through the Parks and Beaches committee to hide the OFA control for at least six months.
The unions $5000.00 arrival in the Kern Recall committee immediately exceeded the 80% state mandated rule requiring disclosure of OFA sponsorship, by the Kern Recall Committee for the donation. Christine Gow, not only came with the money from the Parks & Beaches Committee, she also brought the knowledge of the source of the money, being the Firefighters Union. As in the Parks and Beaches committee, this $5000 donation, again activated a state law requiring the committee to identify the sponsorship of the Firefighters Union in the title of the campaign finance records and all subsequent associated documents, ads, flyers, etc. This notification was not done again, and subsequent campaign finance reports were falsified by Christine Gow, and Carolyn Krammer to hide the source of the money. Once again committee members falsified Public Records under penalty of perjury, which is criminal conduct, and even worse when the falsification is done in furtherance of a conspiracy to tamper with an election and manipulate the votes of citizens.
The OFA $5000.00 was then paid by the Kern Recall committee to The La Jolla Group, as a down payment on the Kern Recall signature drive. The La Jolla Group is a commercial company in San Diego with a specialty in providing commercial campaign signature drives, which do not require the time consuming process of organizing citizen volunteer groups.
The evidence that the $5000.00 was always intended to be used, to quietly set up the signature drive, without citizens becoming aware that the Firefighters Union was in financial control, comes from the campaign finance records. When the Kern Recall used the OFA $5,000.00 as a deposit to activate the contract with the La Jolla Group, it also activated the OFA Third Money Channel. The OFA then made a direct payment of $20,889.00 to the La Jolla Group to seal the contract and start the commercial petition drive. This payments could be hidden for six months inside the OFA records, or until after the city council vote on the petition signature drive. The coordinated flow of illegal money from one source, the OFA, through multiple channels to the same destination, the La Jolla Group, is the kind of criminal conspiracy evidence that honest District Attorneys dream about.
The Firefighters Union records, for these periods were finally released late, and eventually dated August 20, 2009. This was almost a month behind the state required reporting date of July 31. This was done to keep the release of financial information secret, until after the illegally obtained signatures were submitted to the council to set a recall election date. Charles Lowery also delayed the first release of his campaign finance records until July 28 to support the police and fire conspiracy to hid the money trail until the council had approved the signature petition results.
The falsified first quarter Kern Recall campaign finance records were hastily updated in August to reflect the required Firefighters Union sponsorship, and hide the election fraud. These record updates were a direct result of various editorial news media sources, and citizens questioning, and reporting on, the Firefighter Union hiding the financial control over the Kern Recall campaign. The media editorial reports were occurring during late April and early May, but showed no evidence of media investigation. The union story line was then pushed, that the Firefighters Union was just supporting the senior citizens that were recalling Kern, while continuing to keep their financial records secret.
After the falsified Kern Recall first quarter reports were filed, the Firefighters Union then donated an additional $20,000 in cash between May 3, and May 20 to the Kern Recall. This $20,000 was also paid by the Kern Recall committee to the La Jolla Group who was handling the signature drive. This was the third coordinated money payment from the OFA Union to the same destination, the La Jolla Group. Payments for the same petition drive contract, while the Parks and Beaches Committee and the Kern Recall Committee falsified their records to hid the money source, and support the falsified campaign literature. The OFA total expenditures to the La Jolla Group are now in excess of $45,000.00 dollars and 100% of the cost of the commercial signature drive. As stated above, this is the kind of criminal conspiracy evidence that honest District Attorneys normally dream about, except when the criminals are cops and firemen.
THE UNION PUBLIC CORRUPTION SUPPORT
During 2009 more than $193,000.00 dollars went thru the Kern Recall Committee with only one citizen contribution of $125.00. More than a $193,000.00 came from the Oceanside Firemen, Police Officers, and 3 other unions. In the final months of the election fraud conspiracy, as Police and Firefighter financial resources were running low, the United Here Unions stepped in with $68,852.45 for campaign literature, wages, etc. The AFL-CIO San Diego Imperial Counties Labor Council provided an additional $9,628.70 for phone bank operations, wages, food, etc. This provided an additional $78,000.00 plus for the OFA to continue the election fraud conspiracy. The Orange County Firefighters Union provided an additional $15,000 loan to support the Oceanside Firefighter and Police criminal conspiracy.
KERN RECAL CAMPAIGN FINANCE RECORDS (8 PARTS)
The Firefighters Union 2008 and 2009 payments, from all three money channels, for ads and flyers with fraudulent misrepresentations were designed to illegally manipulate the votes of citizens, which is criminal conduct. The fraudulent ads were designed to contaminate the pool of potential citizen signatures in favor of the Kern Recall. This was done by the Fire & Police Department Union PACs, through non-monetary contributions, direct expenditures, and cash contributions to supporting committees like Mayor Wood and Deputy Mayor Sanchez, that by design do not show up in the Kern Recall financial reports. The additional money that was provided to Mayor Wood and Council member Sanchez, even though they were not up for re-election in the next term, was done to insure their continued protection, and support in the city council should any problems or citizen complaints arise. Mayor Wood and Council Member Sanchez opposed, and dismissed all complaints and citizen calls for criminal investigations. CM Kern was under direct attack in the recall election, and CM Chavez had been under financial and personal attack from Mayor Wood and Deputy Mayor Sanchez for years. The message was clear, step out of line and the police and fire departments will crush you and your family.

The statement is a series of lies, and criminal election fraud. The three channel, illegal money trails, documented in the campaign finance records clearly show that the entire recall process was a criminal conspiracy planned, executed, and financed by the police and fire unions, three outside unions, a few union supporters in key PAC committees, and key City Council Members, in key positions to cover up and protect the election fraud conspiracy. The signature drive was planned from the beginning to exclude citizen involvement. The fraudulent media blitz was planned and executed to support the illegal manipulation of citizens votes.
THE 2009 CITY COUNCIL VOTE MANIPULATION
The Firefighters and Police Unions conspiracy also coordinated the delayed filing of their campaign finance reports until August 20, 2009. This was done in violation of campaign finance laws to facilitate the manipulation of the votes of non pro union council members. This was almost a month behind the normal July 31 filing date limit. This became necessary, when the required number of signature petitions was not completed early enough to submit documentation to the city council in July, and start the election date setting process. If the Firefighter and Police Unions financial information was investigated before the council vote, it would have provided strong evidence that the Firefighters and Police Unions had criminally conspired to falsify and tamper with the election. The Fire & Police Departments and their union had totally financed the election fraud, falsified campaign literature, falsified campaign finance records, and manipulation the signature drive and the votes of citizens. The Police, Mayor Wood and Council Member Sanchez, with the silence of other council members, had obstructed and blocked all citizen complaints of election fraud.
The cover up was to protect more than the election fraud. It was also to protect large scale police and DA evidence tampering that surfaced in the middle of the election fraud. Police and District Attorney evidence tampering cover ups that would have exposed and derailed the election conspiracy, and sent many people to prison.

Petition drive corruption and falsified public records evidence, submitted to a non-union vote majority council, could have provided legal cause to deny the council approval of the signature drive, and tanked the entire conspiracy effort. The Firefighters Union also knew from the beginning, that in order to get a recall election date set, before the council vote on a new contract in January 2010, they had to have a recall election date set before the 2009 Christmas Holidays.
In order to guarantee a recall election date in November or early December 2009, taking into account mandated time restrictions, the completed signatures had to be submitted to the city council no later than July, which turned out to be August 12, as no council meeting were available in late July. The only way to organize and complete a signature drive, with minimal citizen opposition, within the limited time between January and July, is to eliminate the involvement of the citizens, and manipulate their votes. That is why the Firefighters Union wanted to secretly hire the La Jolla Group, a commercial petition signature company. The evidence shows that the Fire Union with the financial support and protection of the Police Union, executed a criminal conspiracy to manipulate the votes of citizens, and tamper with an election to improve their pay and benefits. The criminal fraud initial cost to the citizens of Oceanside, for the special election, was estimated at $500,0000.00. This does not include the cost to citizens to fight the fraudulent special election, and the city already had a projected deficit in the millions, mostly due to the existing financial obligations to the police and fire department union contracts.
COORDINATED PUBLIC CORRUPTION COVER UP
All criminal complaints to the City Council, the Oceanside Police Department, the San Diego County District Attorney's Office, and Attorney General Brown were ignored and buried for mutual protection from investigation and prosecution. Any Public Union corruption investigations would shut down public union cash donations and end union controlled political careers.
The Police, Firefighters, and District Attorneys could be assured of protection from the Attorney Generals Office as the same unions financing the election fraud, were the same unions financing the campaigns of AG Jerry Brown for Governor, and Kamala Harris for Attorney General.

Council Member Kern survived the recall conspiracy, however, his backbone and that of Council Members Feller and Chavez did not. The Police and Fire Departments financial assault and intimidation silenced all three council members, when it came to complaints from citizens about police and fire public corruption.
Council Member Rocky Chavez ran for cover, resigned, and took a job with the state veterans administration. Kern and Feller have remained quiet following the election fraud, police fire corruption, and through out the extensive Police and DA evidence tampering conspiracy. Chavez's immediate resignation abandoned the citizens of Oceanside, and our veterans, and set up a second opportunity for the Police and Fire Departments to restructure the council before the new union contract vote.
A special election vote held in June 2010 to fill Chavez's abandoned council seat resulted in Charles Lowery being elected by a very narrow margin. Lowry then provide what the Police and Fire conspiracy was all about, that third vote, on a new expanded police and fire contract that could bankrupt the citizens of Oceanside. The new contract leaves the citizens of Oceanside in extreme debt, with an organized crime public safety system, that cannot be trusted to follow the law.
The public corruption is an FBI designated "Threat To National Security", but there is no evidence of an FBI investigation, and they have been given documentation and complaints on everything.
