Deputy District Attorney Damon Mosler's Special Operations Division (Internal Affairs) Coordinating Obstruction of Justice In the San Diego DA's Office
On November 4, 2009, as a citizen, this reporter met with Deputy District Attorney Damon Mosler and DA investigator Snyder, and filed multiple felony criminal complaints, with documentation (Recorded On Audio Tape). The complaints were filed against DDA Laura Gunn for evidence tampering and obstruction of justice, in the Officer Damon Smith evidence tampering cover up, various supporters of the Oceanside Police & Fire Department and their unions for election fraud and falsification Of campaign finance records, and against Deputy District Attorney David Latuca for obstruction of justice in the DA criminal insurance fraud scheme.
The complaint process was audio recorded to verify submission of the complaints, due to extensive obstruction and resistance by the District Attorneys Office, to the filing of criminal complaints involving District Attorneys and Police Officers. DDA Mosler is the head of the DA's Special Operations Division, which is the internal affairs of the DA's Office. DDA Mosler stated DDA Gunn worked for him and he reported to DA Bonnie Dumanis.
Audio Tape - Criminal Complaint Filing Process
All the complaints and investigations were suppressed by the District Attorneys Office, with no follow up. Public Records request were ignored and suppressed, citing it was in the publics best interest. Complaints to the Attorney Generals Officer were also suppressed and ignored because of the involvement of multiple police officers and District Attorneys, and so many corrupted cases. More importantly, the same unions that were financing the Oceanside Police and Firefighters election fraud conspiracy were also financing AG Brown's run for the Governors Office.
DDA Mosler's motives for this obstruction of justice were wide ranging:
1. The Oceanside Officer Smith eight years of audio tape evidence tampering in criminal prosecutions, and his knowledge of other Oceanside Police Officers that were involved, placed hundreds, if not thousands, of past prosecution cases in jeopardy of new investigations and trials.
2. DDA Laura Gunn's was working under DDA Mosler, while obstructing the investigation of Oceanside Officer Smith, which included the suppression of a witness, to the involvement of other Oceanside police officers. More police officers would expand the number of corrupted cases. Any criminal investigation of the Oceanside Police and Fire Departments election fraud, would lead directly back to the Officer Smith evidence tampering. DDA Gunn would be terminated shortly after the criminal complaint was filed, to shut down any criminal investigations.
3. On November 13, 2009, nine days after the criminal complaints were filed with DDA Mosler, the DDA Daniel Rodriguez evidence tampering surfaced in the news media. DDA Rodriguez was caught hiding audio tape evidence in the Shippee Case criminal prosecution, just like Oceanside Officer Smith. Rodriguez had suppressed victim audio tape statements that showed three men charged with rape and kidnapping, were over charged, while the audio tape evidence that could clear them was hidden. The audio tape was hidden while Rodriguez pressed the suspects to take a plea bargain for less jail time, on felony crimes the evidence did not support. Plea bargains are a very effect tool to cover up DA and Police evidence tampering. DDA Rodriguez was placed on suspension pending a DA's investigation. That investigation would have been handled by DDA Mosler's Special Operations Division.
4. DDA Rodriguez was also removed from the prosecution of Michael Shields, where audio tape evidence taken by Oceanside Officer Jon Domonique, was also hidden. Mike Shields was being prosecuted for felony assault with a deadly weapon, for a crime that did not exist, and the hidden audio tape statement was the proof. Audio recording proof that the Police and District Attorney's repeatedly stated, "did not exist". Four months later in March of 2010, on the first day of trial, with Officer Domonique facing examination under oath, and Mr. Shields rejecting all plea bargains, the audio tape evidence was suddenly found by the DA's Office. As soon as the jury heard the tape, Shields was found not guilty on all counts. Any investigation of DDA Rodriguez would have also come under the supervision of DDA Damon Mosler. DDA Rodriguez, like DDA Gunn, would be quietly terminated to shut down all investigations, when criminal complaints were filed with the DA's Office.
There are now four (4) separate occurrences of evidence tampering by Oceanside Police Officers and District Attorneys, all of which involve the hiding of audio tape evidence, in criminal prosecutions of innocent or over charged citizens. All of these cases were actively occurring in the month of November 2009 in the Special Operations Division. All of which DDA Mosler has direct knowledge of, and supervision over.
There is also another on going major driving motive for the criminal cover up, involving more evidence tampering in the DA's Office. District Attorney Bonnie Dumanis, DDA Laura Gunn, and the San Diego DA's Office have their names on a $20,000,000.00 civil lawsuit for tampering with evidence in the Cynthia Sommer murder prosecution. An innocent woman was sent to prison for killing her husband, based on evidence that did not exist, and a judge stated, the evidence appears to have been fabricated, by DA Dumanis and DDA Gunn. There is no observable evidence of a criminal investigation of either DA Dumanis or DDA Gunn.
DA DUMANIS $20 MILLION DOLLAR EVIDENCE TAMPERING CONSPIRACY IN SOMMER MURDER PROSECUTION
Sommer's release was ordered by the court, with an order for a new trial. DA Dumanis's best choice to head up, and obstruct, the Officer Damon Smith evidence tampering investigation would be DA Dumanis's co-defendant, DDA Laura Gunn. DDA Gunn was appointed to head up the investigation in May of 2009. It would be highly unlikely that DDA Mosler, as head of the DA's Special Operations Division and DDA Gunn's boss, would not know about the Cynthia Sommer $20,000,000.00 civil litigation. All of these experienced attorneys would understand the significance of suppressing multiple case of large scale evidence tampering by DA's and Police. The disclosure of massive evidence tampering is the last type of "smoking gun evidence" that DA Dumanis, DDA Gunn, and the DA's Office would want to provide to Plaintiff Sommer's attorneys in a $20,000,000.00 civil litigation. The loss of large amounts of public money in civil litigations, due to public criminal corruption, would also affect available financial resources for future union contracts. It would also adversely impact the unions public image, which they needed to negotiate for new contract expansions, just like the Oceanside Police and Fire election fraud conspiracy. A police and fire union election conspiracy currently being protected from investigation and prosecution by DDA Damon Mosler and the DA Special Operations Division.
The multiple criminal complaints filed with DDA Mosler on November 4, 2009 were never followed up, or investigated. Multiple phone calls requesting information and interviews were not returned, or answered with, "no comment". Detailed written follow up complaints sent on 2-9-10 to DA Dumanis and the Department of Justice, and on 5-6-10 to DA Dumanis, The Department of Justice, and the FBI were simply ignored, and buried with no follow up, because there were too many badge carrying Police Officers, Firemen, District Attorneys, and elected officials involved in the public criminal corruption.
