An Innocent Man (And His Family) Criminally Prosecuted To Cover Up Massive Evidence Tampering, Election Fraud, And Obstruction Of Justice, By Oceanside Police And The District Attorney's Office.
The Victim
On the morning of February 25, 2009 Mike Shields, and his family, had no idea that he would be arrested for a felony crime, he did not commit, and prosecuted to cover up extensive police and district attorney evidence tampering, conspiracy, obstruction of justice, election fraud, and other felony criminal conduct, by police and district attorneys. The deck of public corruption was stacked against Mike Shields and his family, before he even got out of bed that morning in February 2009. The deck was not only stacked, it was well greased with tax dollars, from extensive public criminal corruption. The objective of the corruption was to control the access to, and use of hundreds of millions of dollars in tax payer money by police, district attorneys, firemen, their public unions, and public officials protecting the scheme in exchange for campaign finance money. The political city council support was driven by greed, and fear of retaliation from the police, and firemen, and their powerful well financed unions.
Shields stated that about 3 months after the arrest in May, he and his attorney David Bortje, meet with Deputy District Attorney Daniel Rodriguez. Shields and Bortje were requesting a copy of the audio tape statement that Shield had given to Officer Domonique the night of his arrest for Assault With A Deadly Weapon. This was the first of many request, to multiple District Attorneys. Each time the request was made, the District Attorney's Office stated that the DA's office and the Oceanside Police had no knowledge of any audio tape statement, taken from Shields, by Officer Domonique. For the next seven months DDA Rodriguez, and later DDA Silva would push Mike Shields to plead guilty in exchange for reduced time in prison, for a crime he did not commit.

CRIMINAL COMPLAINT FILED AGAINST OFFICER DOMONIQUE, SUPPRESSED BY OCEANSIDE POLICE, SAN DIEGO DISTRICT ATTORNEY'S OFFICE, AND THE SAN DIEGO ATTORNEY GENERAL'S OFFICE
POLICE MISCONDUCT AND CRIMINAL COMPLAINT FILED WITH & SUPPRESSED BY THE OCEANSIDE POLICE INTERNAL AFFAIRS DIVISION
In October 2009 DDA Rodriquez was caught withholding audio tape evidence in the "People V. Shippee" case coming out of San Marcos, Ca. Three men were arrested and charged with rape and kidnap, among other crimes. The audio tape statement evidence that was hidden, was the victim's statement. A statement that indicated the men were over charged in the case, and there was no rape or kidnap. However, while DDA Rodriguez hid the evidence tape that could clear them of many of the charges, Rodriguez pushed the defendants to plead guilty, in exchange for a lighter sentence, just like Rodriguez was doing in the Shields prosecution. Only when the news media reported on the Rodriquez corruption, he was suspended from the DA's Office pending investigtion, and removed from the prosecution of the Shields case. Rodriguez was later, quietly terminated, and declared a personnel problem to shut down criminal complaints and investigations against DDA Rodriguez, the Oceanside Police and Fire Departments, and the DA's office. The DA's office was protecting other corrupted prosecutions by Rodriguez from new investigation, just like the false Mike Shields prosecution.
DDA Rodriguez was replaced by DDA Elizabeth Silva. DDA Silva continued to deny the existence of any audio tape statement, taken by Officer Domonique of the Oceanside Police Department, and continued pushing for a guilty plea from Shields right up to the day of trial.
In March of 2010 as the trial was starting, Shields maintained his claim of innocence and would not plead guilty. Shields stated, that he and his family were terrified of the prospect of going to prison. Shields even contemplated suicide out of pure fear. Only at the last minute, when Officer Jon Dominique was faced with taking the stand, under oath, and answering questions about the missing audio tape statement, did the conspiracy start to unravel.
Surprise, Surprise!!!
DDA Silva suddenly has the audio tape statement. The audio tape that the District Attorney's Office and the Oceanside Police had been denying the existence of, for almost a year. A tape that proves the innocence of Mike Shields, and the jury agreed, with a not guilty on all counts.
The Criminal Cover Up
DDA Silva claims that she did not know the tape had been hidden, and had read the riot act to Officer Jon Domonique for hiding the tape. As soon as DDA Silva stopped denying knowledge of the evidence suppression, she started arguing the position to the court that the audio tape statement should be suppressed, as hearsay. The court denied the request. The jury listened to the tape and came back with a Not Guilty on all counts.
DDA Silva knew that the audio tape was smoking gun evidence of felony criminal conduct by Officer Jon Domonique and DDA Daniel Rodriguez. Silva had also replaced DDA Rodriguez when he was suspended for exactly the same type of evidence tampering in the Shippee case. The DA and Police once again were hiding audio tape evidence, just like the Officer Damon Smith eight year evidence tampering spree, while they pushed an innocent man to take a plea bargain for less prison time, on a crime he did not commit.
The District Attorneys Office knew that the only way to keep the Officer Domonique, and DDA Rodriguez evidence tampering quiet, was to force a plea bargain before anyone found out about the suppressed audio tape statement. A plea bargain would allow the suppressed audio tape statement to remain missing, and the criminal conduct of multiple DDA's and Police officers could be buried, as usual.

Oceanside Officer Jon Domonique's negligent field investigation of a traffic accident, resulted in the false felony arrest of Mike Shields. As Officer Domonique took the audio statement, he realized that he had the victim under arrest, and there was no assault with a deadly weapon. Officer Domonique had two choices.
- He could report to his superiors that he had been negligent in his field investigation, and made a false felony arrest of the victim, which was not supported by the evidence, and that would not be good for Officer Dominique’s career with the OPD.
- Or, he could hide the audio tape statement, falsify his felony police report, and allow an innocent man to be prosecuted, with the knowledge that most cases of this type go to a plea bargain before trial.
Officer Dominique chose to hide the audio tape, omit all references from the police report that an audio statement had been taken, and limit the information placed in the report to insure a successful prosecution. Officer Dominique omitted extensive critical information that would clear an innocent man of a felony charge.
The all out criminal assault on the Mike Shields family, destroyed them financially and emotionally. All of Mike shields college saving was spent on a criminal defense attorney. His marriage and family relationships stressed to the breaking limits, while dirty cops and dirty DA's once again hid the evidence that would clear an innocent man. At present the Shields family is being sued in civil court by the suspect that filed the false charges against Mike Shields, and the suspect is using the false arrest as evidence while the Oceanside Police, City Council, and District Attorney Dumanis circle the wagons to suppress all information, complaints, and investigations of the public corruption.
This reporter is a former police officer from two different California cities. I have zero tolerance for corruption in any public safety agency. I reviewed the police reports prepared by Officer Domonique, and a transcript of the hidden audio tape. I am embarrassed and appalled at the conduct I have seen coming out of the Oceanside Police Department, and the San Diego County District Attorney's Office. As a citizen of Oceanside this reporter filed the following criminal complaint against Officer Domonique, with the Oceanside Police, complaint #10006794, the District Attorney's Office, and the California Attorney General's Office. The criminal complaint and associated documents clearly tells the Michael Shields story. The complaints, as usual were ignored and suppressed by all public agencies, for mutual protection, because the crooks are wearing badges. Felony criminal complaints in writing, and there is no follow up, or investigation.
Public complaints were also presented in front of the Oceanside City Council on the criminal assault on the Shields family. The Oceanside City Council, as usual suppressed complaints and investigations, and walked away to protect political careers, and campaign finances from dirty cops and dirty firemen.
The cover up of Officer Domoniques evidence tampering, was to protect other on going criminal operations in the San Diego County District Attorneys Office, the Oceanside Police and Fire Departments, and the City Council. The District Attorney's Officer was scrambling to avoid new investigations and prosecutions on hundreds, if not thousands, of previous prosecutions, due to evidence tampering by multiple DA's and multiple police officers. Oceanside Police and Fire Departments, and member of the City Council were already under press investigation for cover up of election tampering, extensive evidence tampering and insurance fraud by other officers, of the the Oceanside Police Department.
The complaint with criminal allegation which were filed with the District Attorneys Office by this reporter, against DDA Rodriguez, was suppressed by the DA's office, the same as previous complaints involving Officer Damon Smith, Mayor Jim Wood, DDA David Latuca, DDA Damon Mosler, and DDA Laura Gunn. DDA Rodriguez was quietly terminated, and declared to be a personnel problem, to shut down criminal complaints and information access, and to protect past prosecutions, just like the DDA Laura Gunn evidence tampering complaint.
More than a dozen public oral complaints in open council meeting to the Oceanside City Council, and Chief Frank McCoy of the Oceanside Police Department, over a period of months, on all areas of this criminal corruption were ignored and suppressed, including the Mike Shields false prosecution. Oceanside, like most public entities, view citizen civil damage complaints as a loss of money resources available for their public union pay and benefits.
The suppression of complaints by the Oceanside City Council was to protect the cash flow from the police and fire unions into the re-election campaigns of Mayor Wood and Council Member Esther Sanchez, and the election campaign of new Council Member Charles Lowry. It was also to protect political careers, and the ongoing police and fire departments conspiracy in the financing of election fraud, the insurance fraud scheme, the evidence tampering by Oceanside Police Officer Damon Smith, and the identity of other officers implicated by Damon Smith.
