In 2008 it become more and more difficult to tell one crook from another, in the San Diego County District Attorney's office. San Diego County District Attorney Bonnie Dumanis, and the DA's Special Operations Division (Internal Affairs) was secretly running a criminal protection system, for Dirty Police and Dirty DA corruption, that goes back at least eight years, and it involves wide spread criminal conspiracies to obstruct justice in criminal prosecutions, evidence tampering, and first responder election fraud. All of the public corruption, in one way or another, is linked to protecting and expanding union money, including the DA's criminal insurance fraud scheme against citizens. Public exposures of the DA's conspiracy cover up blue print would surface many time, but the hard evidence would be hidden for the next four years, until the accidental release of an attorney client privledged e-main in the DDA Marugg corruption cover up.

CRIMINAL CONSPIRACY -California Penal Code Sec. 182(a) - "IF TWO OR MORE PERSONS CONSPIRE TO COMMIT A CRIME", ANY CRIME.

Co-Conspirator (Accessory)

In most U.S. jurisdictions today,......... an accessory can be convicted even if the principal actor is not arrested or is acquitted. The prosecution must establish that the accessory in some way instigated, furthered, or concealed the crime.

An accessory after the fact is someone who knows that a crime has occurred but nonetheless helps to conceal it. Today, this action is often termed obstructing justice.

In Criminal Law, contributing to or aiding in the commission of a crime. One who, without being present at the commission of an offense, becomes guilty of such offense, not as a chief actor, but as a participant, as by command, advice, instigation, or concealment; either before or after the fact or commission.

A HISTORY Of PUBLIC CORRUPTION COVER UP

The November 2007 court ordered release from prison, of wrongly convicted murder Cynthia Sommer , based on evidence that District Attorney Bonnie Dumanis, DDA Laura Gunn, and others had fabricated evidence to convict an innocent woman, set into motion a series of criminal conspiracies to obstruct justice. Those conspiracies involved DA Dumanis, DDA Gunn, the San Diego District Attorney's Office, local law enforcement, and many other public officials. Conspiracies that were designed and executed, to protect tens of millions of dollars in public agency and union assets, to cover up the public corruption, and to avoid criminal prosecutions of district attorneys, police officers, union officials, and their political and financial supporters.

The GTI News investigation of the San Diego District Attorney's Office started in 2008, with the discovery of a California State financed criminal insurance fraud "Pay For Play" scheme operating out of District Attorney's Offices state wide. District Attorney offices have secretly agreed to protect insurance companies from citizens criminal insurance fraud complaints in exchange for extra money from the state, and to provide prosecutions of citizens on demand from the insurance companies and other private companies. The money is provided in the form of "Special Funding Grants".

DISTRICT ATTORNEY STATE FINANCED CRIMINAL INSURANCE FRAUD OF CITIZENS

Citizens criminally defrauded by insurance companies are pushed to hire an attorney, and litigate criminal fraud in civil courts, if they can afford it. Criminal conspiracy by law enforcement agencies, to obstruct justice for money, is a violation of multiple California State Penal Codes, and Federal laws. Extremely serious crimes, unless you are district attorneys with the power to cover it up. A cover up that requires the support, and protection of local law enforcement, like the Oceanside Police Department. The investigation of this insurance fraud pay for play scheme lead to the discovery of large scale DA and Police evidence tampering, and election fraud for union profit, with mutual protection that was occurring through out San Diego County.

The Oceanside Officer Damon Smith evidence tampering was the "Criminal Monkey Wrench", that showed up in April 2009, in the middle of DA Dumanis's Evidence tampering protection conspiracy in the Sommer $20 Million dollar civil litigation, the insurance fraud scheme cover up, and the Oceanside Police and Fire Departments conspiracy to tamper with an election for public union profit. DA Dumanis was actively trying to avoid civil and criminal liability, from the Cynthia Sommer murder prosecution, and the Oceanside police and fire departments were protecting an on going election fraud conspiracy. All citizen complaints on the corruption were being blocked by DA Dumanis and the DA's office.

In late April of 2009 a reporter named Terri Figuerora of The North County Times, covering the north county courts, posted her story, "Oceanside cop's cashe of tapes under investigation". Officer Smith had been giving testimony in a domestic violence case. Criminal Defense attorney Andrew Lynberg stated he did not feel the officer was being completely truthful, and was actively challenging Officer Smith's testimony under oath. Officer Smith then testified that the proof of his testimony had been recorded on audio tape. As no audio tapes had been referenced in the police report, and no audio tapes had been turned over to the defense as is required by law, red flags went up.

Addition questioning disclosed that Officer Smith had been secretly making audio recordings, while actively involved in criminal investigations, and hiding the tapes from the criminal justice system for the past eight (8) years. Police reports had been falsified for eight years, to cover up the existence of the tapes, and every time Officer Smith took the stand, raised his hand, and swore to tell the whole truth, and nothing but the truth, he lied under oath. Hundreds of felony criminal violations, by just this one police officer, involving eight years of criminal investigations and prosecutions, and officer Smith was not the only Oceanside police officer involved.

DA Dumanis, and the District Attorney's Office, immediately recognized the potential danger that Officer Smith's eight years of evidence tampering posed to DA Dumanis, and the DA's office, with the Sommer civil case investigation underway. It was "smoking gun evidence" that could be used directly against DA Dumanis, DDA Gunn, and the DA's office. If Damon Smith started talking about the involvement of other police officers, that were connected to other DDA's, the cover up could not be contained, and more corruption evidence would be available to Sommer's attorneys. The Officer Smith evidence tampering tapes investigation, was quickly pulled into the Special Operations Division of the District Attorneys Office under DDA Damon Mosler. DDA Laura Gunn, Dumanis's co-defendant in the Sommer litigation was assigned to head up the Smith evidence tampering investigation. This was done to control and suppress the investigation, and protect Officer Smith from arrest to keep his mouth shut about other officers, and to minimize the number of corrupted prosecutions.

The DA's office seized the Smith investigation, even thought the investigation was a major conflict of interest for the District Attorneys Office, but it was the only way to control, and limit the investigations of the Oceanside Police Department. District Attorney Dumanis, and Chief of Police McCoy, within weeks of the Smith testimony, started making press releases, to redefine the extensive criminal evidence tampering, as "non-criminal recording of conversations". DA Dumanis went on to state that Officer Smith had not violated any laws and would not be prosecuted.

The District Attorney's investigation had just started with the assignment of DDA Laura Gunn, and DA Dumanis, and Oceanside Chief of Police Frank McCoy were actively involved in press manipulation, proclaiming the innocence of Officer Smith, to prepare the press and the public, for a no prosecution scenario. Such public statements are direct violations of departmental policies and procedures, on all active investigations. An investigation that would be blocked from the news media coverage for the next nine months with claims of no comment, due to an on going investigation. DA Dumanis, and Chief McCoy had already decided there would be no real investigation, and Officer Smith would be protected. If Smith was arrested, any competent defense attorney would immediately start plea negotiations, for the testimony of Officer Smith against other police officers, in exchange for less prison time, just like all DA prosecutions. The process is regularly used to increase success statistics, reduce the number of trials, and the tactic would be quickly used in the ongoing prosecutions of non-law enforcement suspects like the Mike Shields case, the Eric Lido case, and the Shippee case involving Office Domonique and DDA Rodriguez.

District Attorney Dumanis, an experienced DA, clearly understood what the political, financial, and public image cost would be for the DA's office, with a major criminal investigation of evidence tampering, and obstruction of justice in the Oceanside Police Department and the DA's office. Dumanis also understood, like any experienced investigator, that eight years of police evidence tampering by Officer Smith, in a small police department, could not have gone unnoticed, without the involvement, and knowledge of other Oceanside Police Officers. That kind of revelation would expand the number of potentially corrupted prosecutions from hundreds, into the thousands. (Other Oceanside Police Officers were later exposed in more audio tape evidence tampering.)

THE PUBLIC DEFENDERS OFFICE BLACKS OUT INVESTIGATIONS

Public Defender Steve Carroll, head of the public defenders office, stated in May 2009, with the discovery of the Smith evidence tampering, that there would be a full investigation by his offices, as the defense of approximately 90 percent of all criminal prosecutions are handled by the Public Defenders Office. Mr. Carroll went on to say that the protection of legal rights of the accused is the responsibility of the Public Defenders Office. Mr Carroll, weeks later, retired from the Public Defenders Office, and no investigation was ever started.

Several months later, most of the press reporters, had stopped asking questions, and DDA Laura Gunn, head of the Officer Smith investigation, was still stating no comment due to an on going investigation. Interviews with senior public defender Attorney Bill Trainer, and Henry Coker, the new head of the San Diego County Public Defenders Office, discloses that no one in the Public Defenders Office has even heard anything about the Damon Smith evidence tapes, and there was no investigation of any type, occurring in the public defenders office, related to Officer Damon Smith's audio tape evidence tampering.

The public Defenders office would later join the cover up conspiracy, avoid investigations, and protect the DA's office and the corrupt system.

THE DA'S OFFICE INVESTIGATION & WITNESS SUPPRESSION

On October 6, 2009, with a total lack of evidence, of any real investigation of Officer Smith's evidence tampering by the DA's office, or the Oceanside Police Department, this reporter started back at the beginning. Criminal Defense Attorney Andrew Limberg was contacted. Mr. Limberg was the attorney that discovered the Damon Smith secret recordings of criminal investigations back in April of 2009. Mr Limberg had never been contacted by anyone from the District Attorneys Office, the Oceanside Police, or any other agency investigating the Officer Smith evidence tapes.

Mr. Limberg stated that when Officer Damon Smith finished testifying in late April, Smith approached Mr. Limberg. Officer Smith was very concerned about how much trouble he was in. Officer Smith told Lynberg he did not understand all the concern, and stated that his practice of recording, and hiding criminal investigation audio tapes was "Common Knowledge" among the police officer he worked with at the Oceanside Police Department during the eight year period. Officer Smith was taking openly about the knowledge and involvement of other Oceanside Police Officers in eight years of evidence tampering.

On October 9, 2009, to test the DA's and Police investigations, this reporter contacted DDA Laura Gunn, and the Oceanside Police Department, and gave them the witness information on Officer Smith's statements, involving other Oceanside Police Officers in the eight years of evidence tampering. Three weeks later the District Attorneys office announced the transfer of approximately thirty five audio tapes to the Public Defenders Office, and once again stated that Officer Damon Smith had not broken any laws, would not be prosecuted, and that there was no evidence of other officers being involved.

Additional contacts with witness attorney Andrew Limberg in late October and early November verified that no one from the District Attorney's office, or the Oceanside Police, had contacted him regarding Officer Smiths statements implicating other police officers, in the eight years of evidence tampering. The DA's office and the Oceanside Police had buried the witness information, and shut down the investigations to keep Smith's mouth shut, and protect the DA's case history. The Oceanside Police were happy to participate in the conspiracy, as it would protect the on going police and firefighter election fraud. Side benefits would include avoiding huge civil liability, that would impact the public image of the police, city financial resources available for union contracts, and the future careers of council members, while they were all involved in covering up a union election fraud for profit conspiracy.

On November 3, 2009, this reported meet with Sgt. Ron Hardy, OPD Internal Affairs Supervisor, and CSO Ken Crossman, and filed formal written criminal, and misconduct complaints against Officer Damon Smith. The written complaints contains the witness identity info for Limberg, and Officer Smith's statement information implicating other Oceanside Police Officers, in the eight years of evidence tampering. The complaint filing process was recorded on audio tape for further verification.

On November 4, 2009, as a citizen, this reporter met with Deputy District Attorney Damon Mosler of the Special Operations Division. Multiple felony criminal complaints were filed, with documentation, against DDA Laura Gunn for witness suppression in the Officer Smith evidence tampering investigation, and obstruction of justice. Additional criminal complaints were filed against various supporters of the Oceanside Police & Fire Department and their union for conspiracy to manipulate and falsify an election for union profit, and the falsification of campaign finance records. Complaints were also filed against Deputy District Attorney David Latuca and others, for obstruction of justice in the DA's insurance fraud of citizens scheme. The complaint process was recorded on audio tape to verify submission.

All follow ups with the DA's office between November 2009 and April 2010 were no comment, and all messages requesting contact were ignored. A written complaints was prepared covering the 11-4-09 oral filing to preserve the record, and sent to District Attorney Bonnie Dumanis, and the San Diego Attorney General's Office, with signatures required to confirm delivery. Copies of the complaint audio tape recording was included. The complaints also covered the civil rights violation assaults against Oceanside citizens Rich Shapiro, Eric Lido, Cynthia Sommer, this reporter, and others.

When this reporter questioned Oceanside Mayor Jim Wood on his involvement in the police evidence tampering and it's cover up, Mayor Wood ordered three police officer to seize, and remove this reporter from the city council chambers, with police threats of arrest if I returned. GTI News filed a written criminal complaint with the Oceanside Police and the District Attorneys Office. There was never any follow up, from the DA's or AG's office, on any of the complaints.

THE FOLLOW UP

On April 23, 2010, when this reporter heard nothing from the DA's or their investigators, this reporter again contacted DDA Damon Mosler, and was advised that DDA Laura Gunn no longer worked for the District Attorneys office. DDA Mosler stated that there were no criminal investigations on any of the filed complaints. The quiet termination of DDA Laura Gunn, as usual, was now declared to be a personnel problem, and DDA Mosler cited privacy laws to block all information. DDA Damon Mosler declined to discuss any of the felony criminal complaints this reporter filed on October 4th, or the new Officer Domonique evidence tampering discovered in March of 2010, by GTI News Photo, and reported to DDA Mosler. All of the complaints were suppressed by the District Attorneys Office, without investigation, because they involved large scale police and district attorneys evidence tampering in hundreds of criminal prosecutions.

This reporter also contacted Paul Levikow, media contact for DA Dumanis, and the District Attorneys Office, regarding the DDA Mosler obstruction of criminal complaints on evidence tampering, and the new evidence tampering by DDA Daniel Rodriguez in the Oceanside Officer Domonique audio tape evidence tampering. Levikow advised that DDA Rodriguez, like DDA Gunn, no longer worked for the District Attorneys Office, and DDA Rodriguez was also declared a personnel issue, to use state employee privacy laws as a justification, to shut down information flow on criminal complaints and investigations involving DA's and Police Officers.

Termination of any Deputy District Attorney requires the input, and agreement of District Attorney Bonnie Dumanis. DA Dumanis had actively obstructed justice, in multiple criminal complaints, conspired to suppress witnesses, and quietly remove DDA's that could be used as evidence against her, and the San Diego County DA's office in the Sommer $20 Million dollar litigation. This was done to protect at least eight years of corrupted criminal prosecutions, illegal insurance fraud financing, first responder public union election fraud, and her future political career.

The written documentation on the DA's blueprint to obstruct justice through the quiet termination, or forced resignation of corrupt DDA's would not surface until 2012.
